POLÍTICA DE PRIVACIDAD DEL CLIENTE DE SUUNTO

Thank you for using Suunto devices and services! This Privacy Policy covers all Suunto applications, sites, and related services, which link to this Privacy Policy (collectively the Services). This Privacy Policy applies to persons who use Suunto devices and services as private individuals (not as professionals, for example as members of Suunto Pro Club). This Privacy Policy describes:

· what personal data We collect about you (“customer” or “user” or “data subject”, “you”),

· how We use and share your personal data and the legal grounds for doing so, and

· the rights you have on your personal data.

 

As a minimum, We provide the same level of data protection and privacy controls as in the General Data Protection Regulation of the European Union (“GDPR”) to all our customers worldwide. Particular rights and obligations may apply if you reside in certain locations. 

Learn more about your local rights and how to exercise them.

We may update this Privacy Policy by posting a new version at www.suunto.com and in the Services. If We make any material changes, We will let you know by posting a notice in the Services prior to the change becoming effective. Your continued use of the Services after the effective date will be subject to the new Privacy Policy.

We do not make any decisions based solely on automated processing which produces legal effects concerning you or similarly significantly affects you (Article 22 of the General Data Protection Regulation). 

5 WHAT DATA ABOUT ME IS VISIBLE TO OTHER USERS

Social features are a core component of our Service. Other users may, for example, see your profile data, activities (exercises) and read the messages and other content you have posted. By default, all your data is private, except your public profile, which allows your friends to find you. You can freely decide what information you add to your profile page.

A public profile is visible in the whole Sports Tracker Community when searched by name or email. This means that when you add data to your public profile in one of the applications in the Sports Tracker Community, your public profile is also visible in the other applications. Your profile page displays the following data publicly:

• Name

• Username

• Description

• Profile picture and background photo

• People you follow and people who follow you

• Total distance, split by sports

• Total activities (exercises)

• List of your activities (exercises) that are set to Public

Visibility of an activity (exercise or workout) means the sharing setting of each tracked or logged activity. For simplicity and clarity, the default visibility for your activities (exercises) is Private. There are three visibility options you can choose from:

• Public: Anyone can view and comment on your activity (exercise). Any user that browses public workouts can find and view the activity (exercise).

• Followers: Only followers can view and comment on your activity (exercise). Users that do not follow you cannot find or open the activity (exercise).

• Private: Your activities are visible only to you.

 

In order to create certain anonymous data such as heatmaps of tracks frequently used by users there may be certain features which allow you to enable the collection of certain location data during your activities (exercises) as specified in the applicable visibility options.

Moreover, there may also be certain features which allow you to enable automatic collection of certain location data from your device to the app when your device becomes connected to the app.

In addition to the above, you can also choose to share your activity in an external service, like Facebook. In this case a special link to your activity is created, and anyone following that link can access the activity (exercise).

Leaderboard view displays weekly total information of you and the persons you follow. Likewise, people you have accepted to follow you can see your information:

• Name

• Total duration of all activities

• Other information identified in the Leaderboard within the app

Please note that different apps and versions may have different visibility configurations.

6 ADVERTISING AND SOCIAL MEDIA PARTNERS

If you decide to use your Facebook account and credentials for your log in to the Services, We will receive data such as your name, email address, birth date, gender and profile photo and friends list (to inform you which of your friends have already joined or later join the Services) from Facebook. If you wish not to provide Us with such information, you will need to amend the privacy settings on your Facebook account, so please review the applicable privacy statements and instructions from Facebook for further information.

Our website uses social media functions (i.e. social plug-ins), for example Facebook, Instagram, and YouTube buttons that take you to community pages held by the Us. When you use these social plugins, social media services share user data with Us in accordance with their privacy policies and user consents, e.g. comments and links on Suunto websites shared by the user in the media, as well as information contained in the user's public profile. 

Social plugins are the responsibility of the social media partner. They are responsible for compliance with data protection legislation and for implementing data security and the rights of the users of their services. We encourage you to check their privacy policies to learn more about their data processing practices.

We process personal data obtained through Our social media sites on the basis of legitimate interest only for Our own purposes, such as informing about new products, services or offers, conducting competitions and sweepstakes, receiving feedback, purchasing advertising from a social media service, measuring the availability of pages or advertisements, or customer service on community pages. We do not process data outside social media, and the data they share will not be combined with Our other data without the user's consent. 

Our mobile applications include features from Our partners, such as social media interaction tools, functionalities through application programming interfaces (APIs) or software development kits (SDKs) and in-app advertising. A list of these partners is available at suunto.com. These partners may access your data and operate under their own privacy policies. We encourage you to check their privacy policies to learn more about their data processing practices. These partners may access data regarding your activities and your device (such as your IP address, mobile identifiers, page(s) visited, location, time of day). 

We may also combine and share data We have collected about you with these third-party advertising partners. These advertising partners may use this data (and similar data collected from other services) for purposes of delivering targeted advertisements to you when you visit third-party services within their networks. These partners may operate under their own privacy policies. This practice is commonly referred to as “interest-based advertising” or “online behavioural advertising.” If you prefer not to share your personal data with third-party advertising partners, you may follow the instructions in Section “9 YOUR ACCESS, RECTIFICATION AND OTHER RIGHTS” below.

7 VALUE PACK AND OTHER SUUNTO PARTNERS

We have partnered up with the leading product and service providers in the sports and wellbeing industry as well as a few other selected companies to ensure your training & outdoor experience is enhanced to the max. The partners offer a range of features and functionalities all the way from training planning & analysis to tracking your performance and reliving your activities – and sharing your adventures to the communities you belong.

If you connect your account with Our Value Pack partners or other partners, your personal Exercise, Location and other data will be shared and synchronized with the partner as explained upon connection. Sharing and synchronization is based on your consent. A list of these partners is available at https://www.suunto.com/en-gb/partners/partners/. These partners operate under their own privacy policies. We encourage you to check their privacy policies to learn more about their data processing practices before you connect to their services.

8 OTHER DATA SHARING AND TRANSFERS

Personal data regarding individuals who reside in a country or region other than mainland China that is controlled or jointly controlled by Suunto Oy, is stored on servers in EEA.

For individuals in mainland China, your personal data is collected and controlled by Suunto Sports Technology Co., Ltd and stored on servers in mainland China.

We may share your personal data with Our affiliates who are joint controllers as explained in Section 1 above. 

We may also share your personal data with other companies when it is necessary for the purposes specified in this privacy policy, for example to transportation companies for the delivery, and to payment service providers for the processing the payment of the agreed products or Services.

• Proveedores de herramientas y servicios de marketing que Nos ayudan con el marketing y la publicidad de Nuestros productos y servicios

Cada subcontratista procesa los datos personales solo en la medida necesaria para la ejecución de las tareas del subcontratista. Los subcontratistas están obligados por acuerdos escritos con Nosotros sobre el tratamiento de datos personales, incluidas condiciones relativas a la confidencialidad y la seguridad de los datos.

Cuando transferimos datos personales a receptores fuera de la UE y el EEE, a países donde el nivel de protección de datos no ha sido aceptado por la Comisión Europea (decisión de adecuación), utilizaremos las siguientes garantías para garantizar un nivel adecuado de protección de datos:

· Transferencias a Estados Unidos a destinatarios certificados en el Marco de privacidad de datos UE-EE. UU. y/o a otros destinatarios mediante la celebración de acuerdos escritos utilizando las cláusulas contractuales tipo aprobadas por la Comisión Europea el 4 de junio de 2021 («las CCE») u otro procedimiento legal especificado en el capítulo V del RGPD. 9 SEGURIDAD Y CONSERVACIÓN DE LOS DATOS

Solo las personas que necesiten los datos personales para llevar a cabo su trabajo pueden acceder a ellos. El personal y los subcontratistas que procesan los datos están sujetos a obligaciones de confidencialidad. 

El material manual se almacena en instalaciones cerradas con llave, protegidas con control de acceso físico y videovigilancia. Los datos almacenados electrónicamente están protegidos por cortafuegos y software antivirus de malware, gestión y control de derechos de acceso, conexiones de datos seguras, cifrado de bases de datos y servidores, registros y copias de seguridad de datos. 

Sus datos se almacenarán mientras tenga una cuenta en los servicios y durante un período de un año después. Tras esto, sus datos se podrán mantener hasta que se hayan cumplido, vencido o hayan terminado todos los derechos y obligaciones contractuales o legales entre las partes. Los períodos de responsabilidad y retención tal y como se definen en la legislación aplicable sobre contabilidad u otras leyes o reglamentos pueden exigirnos almacenar los datos durante un período más largo.

 

Los datos de salud y otros datos tratados en función de su consentimiento se podrán tratar mientras su consentimiento sea válido. Por ejemplo, los datos recopilados con cookies se eliminarán de acuerdo con los períodos de retención indicados en la política de cookies.

A menos que se haya opuesto a nuestra comercialización, haya retirado su consentimiento relevante o haya cancelado su suscripción al boletín, los datos de marketing se pueden mantener permanentemente.

Las copias de seguridad de los datos se mantienen de acuerdo con los calendarios normales de almacenamiento y eliminación. 

Datos anonimizados con los que una persona no puede ser identificada se pueden almacenar de manera permanente.

10 SU ACCESO, RECTIFICACIÓN Y OTROS DERECHOS

Tiene derecho a acceder y obtener una copia de los datos tratados por Nosotros que le conciernen y a solicitar la rectificación o eliminación de datos incorrectos, desactualizados, innecesarios o ilegales. 

Tiene derecho a retirar el consentimiento que haya dado previamente para el tratamiento de sus datos personales. La retirada del consentimiento no afecta la legalidad del tratamiento que tuvo lugar antes. 

También puede darse de baja del boletín y dejar de recibir comunicaciones promocionales, como correos electrónicos de marketing, encuestas de opinión e investigación de mercado, incluido el perfilado relacionado con Nosotros, siguiendo las instrucciones de dichas comunicaciones o cambiando las condiciones en la aplicación. La configuración actualizada puede no ser efectiva de inmediato. Puede optar en cualquier momento por no recibir notificaciones push a través de Nuestras aplicaciones móviles cambiando la configuración de su dispositivo móvil. 

Puede permitir que nuestras aplicaciones móviles accedan a determinadas funciones de su dispositivo Android, incluidos registros de llamadas (para habilitar las notificaciones de llamadas telefónicas en su dispositivo Suunto), lista de contactos (para mostrar la información de la persona que llama en su dispositivo Suunto), cámara (para operar la cámara de su dispositivo Android mediante nuestras aplicaciones móviles) y música y audio (para reproducir música en su dispositivo Suunto). Puede ejercer todos los derechos antes indicados siguiendo el procedimiento que se explica a continuación mediante el envío de solicitudes por escrito o por correo electrónico a Suunto Oy (los datos de contacto figuran en la sección 2 arriba) o presentándolas a Nuestro servicio de atención al cliente. Si es necesario, Podemos pedirle que especifique su solicitud y que demuestre su identidad por escrito.

También tiene derecho a presentar una reclamación sobre el tratamiento de los datos personales ante el Defensor del Pueblo de Protección de Datos. 

If you disagree on the accuracy of your data or the lawfulness of the processing, and in other situations defined by law, you can have the processing of your personal data be restricted, such as the total or partial suspension of the processing of your data until the disagreement has been clarified and resolved. 

You can use the rights explained above by sending requests in writing or by e-mail to Suunto Oy (contact details are presented in Section 2 above or by presenting them to Our customer service. If necessary, We may ask you to specify your request in writing and to prove your identity.

You have also a right to lodge a complaint about the processing of personal data with the Data Protection Ombudsman.
